Overview

Mark has extensive experience representing financial institutions and businesses in a variety of transactional matters. His lender representation includes complex commercial loan documentation, workout and loan restructuring, regulatory and compliance matters, intercreditor relationships and agreements, loan sales, enforcement litigation, security interest analysis and bank operations. For Mark's business clients, he adeptly handles the purchase and sale of equity and assets, organizational disputes, governance issues and restructuring. Mark also represents clients in real estate purchase and sale transactions and through all stages of commercial real estate development projects.

Mark also aggressively and effectively enforces and protects his clients' rights in arbitrations and state and federal trial proceedings nationwide.

Experience

Secured Lending

Represents commercial lenders in the due diligence and documentation of commercial and industrial loans, real estate loans, construction loans, and hospitality and entertainment loans.

Real Estate

Handles all documentation and due diligence for real estate development projects and purchase and sale transactions, including commercial buildings and mobile home parks, as well as other residential and commercial developments.

Private Business

Advises on comprehensive formation and operational representation and documentation for all types of business entities, including ongoing governance, equity holder disputes, equity transfers, asset and equity sales, and dissolutions.

Litigation

Represents creditors to preserve and enforce their rights in state and federal courts. Litigates in Chapter 7, 11, 12 and 13 bankruptcy proceedings in various districts of the United States Bankruptcy Courts, including the District of Colorado. Creditor bankruptcy representation includes relief from stay actions through trial and a variety of adversary proceedings through appeal.
