Bell Shares Outlook on Commercial Real Estate Loan Workouts in Denver Business Journal
Stinson LLP Partner Mark Bell was featured in the Denver Business Journal discussing how lenders and borrowers are navigating a wave of maturing commercial real estate loans and the growing use of negotiated loan workouts across the Denver market.
In the article, Bell explained that financial institutions and borrowers are moving away from the "extend and pretend" approach that characterized recent years in favor of more proactive, fact-based negotiations. He noted that borrowers are increasingly coming to the table with realistic financial projections and a willingness to pursue refinancing or other restructuring solutions.
"It's a more proactive approach to dealing with these issues than simply burying their heads in the sand," Bell said. "There was this extend and pretend that seemed to be going on, but now, it seems to me like there's a real focus on meaningful refinancing and working toward negotiated workouts."
Bell also discussed the practical realities of commercial loan workouts, explaining that lenders generally view foreclosure as a last resort and instead seek solutions such as loan extensions with revised terms, ownership changes, additional equity contributions or new financing structures. He emphasized that successful negotiations depend on transparency and early communication between borrowers and lenders.
"I typically represent banks and lenders, but when I do represent borrowers, my advice to them is always to be proactive," Bell said. "Like any other problem in life, if you're proactive about it and forthright, you end up in a better position than simply putting your head in the sand."
