Bell Discusses Colorado Balcony Solar Legislation in Law Week Colorado

Stinson LLP Partner Mark Bell is quoted in a Law Week Colorado article examining key policy developments and legislative trends emerging from Colorado's 2026 legislative session, including proposals affecting housing, energy infrastructure and property governance.

The article highlights HB 26-1007, legislation limiting the ability of landlords, homeowners' associations and condominium associations to restrict the installation and use of balcony solar devices.

"This shifts a measure of control over portions of a building's exterior envelope, balcony areas, electrical interfaces and energy-related infrastructure from centralized property ownership or association governance toward individual occupants or unit owners," Bell explains.

Bell further notes that the legislation may create tension with existing lease provisions, condominium declarations, insurance requirements and architectural-control standards, raising new legal and operational considerations for property owners and associations navigating implementation.
