Jason works closely with inventors, in-house counsel and marketing teams throughout all phases of new product design and development, and tailors patent enforcement strategies to his clients' strategic business needs.
Overview
Jason maintains a broad patent practice encompassing patent prosecution, strategic client counseling, patent licensing and monetization, pre-litigation enforcement, and post-grant proceedings. His representative clients include Fortune 500 corporations, small and mid-sized companies, and early-stage and venture-backed companies. Jason views patent protection as a business tool for achieving clients' unique goals.
With over 20 years of patent experience, Jason obtains valuable patent protection for his clients' innovations and commercial products, while mitigating third-party infringement risks. He prepares and prosecutes patent applications (both domestic and foreign) for offensive and defensive purposes. Jason conducts landscape and freedom to operate searches, and when appropriate, he works with clients on design-around options and drafts non-infringement and invalidity opinions. He is actively involved in monetizing his clients' patent portfolios, including mining existing portfolios, identifying potential targets, conducting pre-litigation enforcement review, and negotiating and drafting license agreements to realize and maximize value. Jason also represents clients in post-grant proceedings, including post-grant review and inter partes review proceedings, before the Patent Trial and Appeal Board.
Jason has assisted clients in a broad range of mechanical and electro-mechanical areas, including medical devices, such as cardiac and vascular devices and implants, and orthopedic implants; healthcare products and supplies, such as DVT compression devices, wound management, and thermometers; consumer goods; construction tools and equipment; electrical and mechanical support systems and enclosures; refrigeration and ice machines; and automated seed collection, processing, imaging and analysis.
Experience
A registered patent attorney, Jason has represented clients in patent issues involving electric motors, HVAC systems, refrigeration, metal fabrication, electrical support systems, silicon wafer production and processing, internal combustion engines, auxiliary systems for gas turbine engines, pneumatic power tools, thermometry, compression devices, atherectomy devices, angioplasty catheters, surgical instruments, orthoses and LED lighting systems.
