Alex also previously served as a Colorado State Public Defender where he tried numerous cases and gained intensive courtroom experience early in his career.
Experience
Insurance Coverage & Bad Faith
- Developed and litigated a novel statutory-interpretation argument that resulted in stays of dozens of cases statewide before review by the Colorado Supreme Court.
- Defended a national insurer in a multi-party construction defect and bad faith action with a multimillion-dollar exposure, resolving the matter shortly before trial for less than 1% of the original demand.
- Achieved a favorable settlement for a commercial auto insurer by securing dispositive admissions from the claimant and filing a targeted summary judgment motion.
- Drove a mid-six-figure settlement for less than half the insurance policy's value in a catastrophic injury coverage dispute by establishing the applicability of the policy's exclusions and limitations.
- Won summary judgment for an insurer in a declaratory action involving construction-related property damage by invoking business-risk exclusions.
Business Litigation & Trade Secrets
- Defended a regional services company in a multimillion-dollar trade secrets and tortious interference case, using focused discovery to reduce the matter for a nuisance-level settlement.
- Secured a seven-figure settlement for a restaurant client in a commercial negligence case involving catastrophic flooding caused by improper plumbing work.
- Obtained dismissal with prejudice for a federal employee in a constitutional and tort action arising from a training exercise at a government facility.
Premises Liability, Products Liability & Personal Injury Defense
- Integrated a products-liability defense theory into an underinsured motorist case, prompting a favorable settlement for far below policy limits.
- Won summary judgment for a grocery store in a trip-and-fall action by demonstrating that wheel stops do not constitute a dangerous condition as a matter of law.
- Secured summary judgment for a hotel in a slip-and-fall case where the plaintiff could not establish the existence of a dangerous condition under the Colorado Premises Liability Act.
