An accomplished trial attorney, Keith enjoys a diverse litigation practice in business and commercial litigation, including all kinds of contract and commercial disputes, regulatory compliance litigation, environmental law, professional negligence defense and banking litigation.

Keith has extensive first-chair courtroom experience, having successfully tried many cases to verdict in both state and federal courts across the country over a thirty-five year career. He also has extensive experience litigating arbitrations and administrative proceedings. Keith's litigation experience informs his advice and counsel to clients on the transactional side, in negotiating contracts, ensuring regulatory compliance and taking other prudent actions to stay out of court.

Experience

Keith’ litigation success includes:

Successfully defending a national bank in a $1 billion Ponzi-scheme case after a month-long trial and subsequent appeal.

Successfully represented the beneficiary of a $75 million charitable trust in a dispute over control of the trust, winning at trial and defending the judgment in the 7th Circuit.

Winning a groundbreaking decision in the Minnesota Supreme Court invalidating the Ponzi scheme presumption and clarifying Minnesota fraudulent conveyance law.

Keith was an assistant attorney general with the State of Minnesota, representing the Minnesota Pollution Control Agency. He also was a law clerk for Chief Judge Donald P. Lay of the Eighth Circuit Court of Appeals.
