James stays up to date on new technologies to efficiently counsel clients across the broad spectrum of IP rights and patent prosecution.
James advises companies on how to protect their intellectual property rights and avoid infringing the rights of others. A registered patent attorney, he prepares and prosecutes patent applications for mechanical and electro-mechanical inventions and counsels on patent infringement and other aspects of intellectual property protection.
James’s IP counsel includes trademark prosecution and clearance, copyright advice, patent non-infringement and invalidity opinions, and negotiation of intellectual property and software development and license agreements. James also conducts intellectual property due diligence for mergers and acquisitions, handles domain name disputes and helps with intellectual property litigation.
James leveraged his automotive industry experience to conduct a freedom to operate review of over one hundred patents to guide development of a complex commercial vehicle component.
He negotiates joint development agreements for large companies working with emerging technology companies.
James stops the infringement of trademarks in the sporting goods and financial services industries, including by initiating UDRP proceedings to obtain infringing domain names.
He prepares and prosecutes U.S. and foreign patent applications for technologies including commercial vehicle brake and suspension systems, internal combustion engines, automotive parts, railcar equipment, agricultural machinery, laboratory equipment, surgical tools, sporting goods, and vape devices.
James maintains a database of competitors' worldwide patents for a multinational corporation to avoid patent infringement for new products developed by the client.
He volunteers for pro bono cases from the U.S. Patent and Trademark Office's Patent Pro Bono Program and Kansas City Volunteer Lawyers & Accountants for the Arts. While at the University of Kansas, James led a team that designed and manufactured a formula style race car suspension for the 2003 Jayhawk Motorsports Formula SAE Team.
