Denyse combines deep energy-law experience with a pragmatic, strategic approach to solving complex regulatory issues before the Federal Energy Regulatory Commission.

Overview

Denyse has presented numerous matters before the Federal Energy Regulatory Commission (FERC), including natural gas and electric utility tariff and rate proceedings, various proceedings involving the operation of regional transmission organizations, regional transmission planning and cost allocation, and oil pipeline proceedings.

An accomplished administrative litigator, Denyse regularly represents state public utility commissions in FERC electric and natural gas matters. Her broad experience includes contract and regulatory matters for privately-held utilities, municipalities, cooperatives and public power as well as on new project certifications.

Denyse has extensive experience representing oil refineries and producers as shippers in oil pipeline proceedings and representing shippers and customers in FERC litigation involving cost allocation and rates.

Experience

Successfully represented oil producer in FERC investigation proceeding of an oil pipeline on the issue of whether oil pipeline was providing jurisdictional transportation service.

Successfully represented state public service commission in federal district court, including appeals to the 8th Circuit and U.S. Supreme Court, addressing federal preemption issues.

Represented state public service commission in negotiations in natural gas pipeline rate cases.

Represented state public service commission in electric rate cases.

Advised electric utilities in implementation of the Public Utility Regulatory Policies Act.
