Zach assists clients in achieving their litigation and regulatory objectives.
Overview
Zach represents clients of all sizes and on both sides in complex litigation, regulatory, and administrative matters, primarily counseling on energy and environmental issues and projects. He has appeared before state and federal trial and appellate courts, local governments, and state regulatory bodies, including the Minnesota Office of Administrative Hearings, Public Utilities Commission, and Pollution Control Agency. Zach’s practice focuses on helping his clients navigate the ever-changing landscapes of energy and environmental law, from enforcement actions, project development, and permitting to the courts and associated appeals.
Zach also maintains an active pro bono practice consisting of immigration and housing work and has a proven track record of success assisting those that need it most.
Prior to joining the firm as an associate, Zach was a summer associate and clerked for the Minnesota Court of Appeals.
Experience
Represented a local business in a Minnesota Environmental Rights Act dispute, successfully achieving a result that both preserved the historical resource in question and allowed the client to continue its business endeavors uninterrupted.
Defended a Class I railroad in a property dispute in federal court that threatened to significantly disrupt one of its service lines. The team prevailed on a motion to dismiss the complaint, conclusively establishing the client’s ownership of the property in question.
Represented an international business in connection with federal appellate and trial court case, and appeared on behalf of the same before state administrative body, ultimately obtaining a favorable settlement with all claims against the business dismissed without an admission of liability.
Appeared on behalf of a renewable energy developer before local permitting board and interested public participants. After discussion and questions, the board issued the required local permit for project.
Represented landowners in local zoning and development matter before town board. The board issued a decision consistent with a letter submitted on behalf of the landowners.
