Traci brings a unique perspective to environmental and regulatory challenges, drawing on experience in government enforcement, environmental litigation and agency proceedings.
Overview
Traci advises clients on proactive compliance strategies and defends clients in enforcement actions and litigation involving federal and state environmental laws. Her experience includes matters arising under the Clean Air Act, Clean Water Act, Resource Conservation and Recovery Act (RCRA), and Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Having previously served as a Trial Attorney with the U.S. Department of Justice's Environment and Natural Resources Division, Traci brings insight into government enforcement priorities, litigation strategies and settlement approaches.
Traci also assists clients with regulatory matters involving energy and other highly regulated industries, including proceedings before state agencies and utility commissions. She helps clients evaluate regulatory requirements, respond to agency actions and develop practical solutions that balance business objectives with compliance obligations.
Experience
While at the Department of Justice, Traci represented federal agencies, including the United States Environmental Protection Agency and the United States Department of Interior, in actions brought in federal court under federal environmental statutes. Traci has a unique understanding of how federal agencies develop, pursue, and resolve enforcement actions.
Additionally, Traci has represented clients in environmental and energy-related regulatory proceedings before state agencies, including the Public Utilities Commission and the Division of Environmental Protection. Before the Public Utilities Commission, Traci represented large energy consumer clients in General Rate Cases, Integrated Resource Plan dockets, and other cost recovery dockets. Before the Division of Environmental Protection, Traci represented clients facing Notices or Findings of Violation and cease-and-desist letters.
Traci has represented clients in cases at the cutting edge of environmental law, including cases brought under the Coal Combustion Residuals Rule and matters covered under the Fast-41 Program.
Traci also works with clients to mitigate environmental risks associated with real estate transactions, including reviewing Phase I Environmental Site Assessments and evaluating potential contamination issues under federal, state and local environmental laws.
