Kevin assists clients with disputes and legal issues related to commercial litigation, equipment leasing, secured lending, real estate litigation, creditors’ rights, and trust and estate litigation.

Overview

Kevin represents lenders, lessors, businesses, trustees, beneficiaries, and property owners in complex commercial disputes. His practice focuses on asset-based litigation, creditors' rights, equipment leasing and finance, secured lending, real estate litigation, and trust and estate litigation. He manages matters from pre-suit strategy through trial and appeal, and clients rely on Kevin for developing practical, business-focused solutions that advance his clients' objectives.

Drawing on extensive experience in equipment leasing and secured lending, Kevin regularly assists lenders and lessors in enforcing loan and lease agreements, recovering collateral, and maximizing recoveries. He has coordinated the recovery of equipment and other assets nationwide, pursued judgments and post-judgment remedies, litigated fraudulent transfer claims, and negotiated workout and forbearance agreements.

Kevin also maintains an active real estate litigation practice. He represents commercial landlords, tenants, lenders, and property owners in lease disputes, eviction actions, foreclosure proceedings, eminent domain matters, and other real estate-related litigation.

In addition, he represents trustees, beneficiaries, and fiduciaries in trust and estate disputes involving undue influence, testamentary capacity, fiduciary duties, and estate administration.

Kevin is committed to serving the community through pro bono work. He advocates for residential tenants in the courtroom through the firm's Eviction Representation Project and assists clients with expungement matters, negotiating favorable resolutions, and avoiding housing instability.

Experience

Equipment Leasing and Secured Financing

Restructured $40 million in secured loans involving collateral across the United States.

Obtained an order for a lender to recover $4.7 million of coal-mining equipment from a borrower in default.

Represented lenders and lessors in the enforcement of loan and lease agreements, collateral recovery actions, workout negotiations, and post-judgment collection proceedings.

Real Estate Litigation

Secured a dismissal of an eminent domain claim asserting $19 million in damages.

Obtained a $250 million foreclosure judgment involving commercial property.

Represent commercial landlords, tenants, and lenders in eviction actions, lease disputes, and foreclosure proceedings.

Trust and Estate Litigation

Defended trustees and beneficiaries against claims of undue influence and lack of testamentary capacity.

Represent fiduciaries and beneficiaries in contested trust and estate matters.
