Stinson Secures Jury Verdict for Marvin Engineering in Aerospace Contract Dispute
Stinson LLP attorneys secured a jury verdict on behalf of Marvin Engineering Company, Inc., a defense subcontractor that designs and manufactures aircraft armament systems for the F-35 Joint Strike Fighter (JSF) program, in a contract dispute involving long-term agreements used within the aerospace and defense industry.
The dispute arose from a series of long-term agreements governing the pricing and supply of aircraft components used in the JSF program. The supplier alleged that these agreements constituted binding requirements contracts that obligated Marvin Engineering to purchase all covered components exclusively from the supplier when orders were placed through its prime contractor. Marvin Engineering disputed that interpretation and maintained that the agreements set pricing and supply terms only, without creating enforceable purchasing obligations.
Following trial, the jury returned a near-unanimous verdict in favor of Marvin Engineering.
