Chatham Discusses H-1B Proclamation on Arizona Horizon
Stinson LLP Partner Elizabeth Chatham spoke with “Arizona Horizon,” a public affairs program on Arizona PBS, about the White House’s “Restriction on Entry of Certain Nonimmigrant Workers” proclamation issued on September 19, 2025.
In the segment, “Trump adds a $100,000 fee to H-1b visa applications,” Chatham explains the significance of the proclamation and its potential impact on the H-1B visa program and U.S. immigration law. The proclamation restricts the entry of certain nonimmigrants seeking H-1B status unless their petitions include a $100,000 one-time payment.
Chatham discusses how the proclamation may challenge American employers, particularly in the IT industry, who rely on nonimmigrant workers. She also clarifies that “the White House administration did clarify that this particular proclamation is prospective. So, anyone who has an approved H-1B is not impacted and will not trigger the $100,000 fee,” meaning that individuals who already hold H-1B visas are unaffected.
She also provides historical context for the H-1B program, noting that the H-1B program was established decades ago and has not undergone significant reform since its inception. She emphasized that the needs of the U.S. economy have shifted substantially since then, underscoring the broader trends shaping immigration policy and their implications for employers and workers today.
