Praised by market sources in Chambers USA as “a smart guy and high-quality lawyer,” Robert holds an excellent reputation for his IP experience, where peers note that “he gets good results for his clients.”
A litigation powerhouse, Robert wins complex intellectual property disputes in federal courts throughout the U.S. In the course of his career, Robert has worked in nearly every major business center nationwide, giving him the knowledge, background and experience to provide clients with the tactical advice they need to successfully resolve complex IP disputes.
Robert has successfully represented clients in the full range of dispute resolution venues, from direct negotiations to mediations and arbitrations to bench and jury trials. He has also handled post-grant proceedings before the USPTO Patent Trial and Appeals Board. In addition to winning jury verdicts in high-stakes patent litigation, he has strong appellate experience and has won summary judgment in complex patent cases where the plaintiff demanded tens and hundreds of millions of dollars.
Robert has first chaired many jury trials and argued many appeals to the U.S. Court of Appeals for the Federal Circuit.
Robert's lawsuits have involved electronic circuits and electrical controls, computer systems and software, telephone systems and software, voting equipment, mining equipment, commercial food preparation equipment, organic and inorganic chemistry, semiconductors, integrated circuit plating baths, life sciences reagents and processes, medical devices, robotics, dental products, financial services, entertainment, LED manufacturing processes and illumination systems, GPS systems, and other manufactured and industrial products.
Through summary judgment of non-infringement on one patent and a jury verdict of invalidity on two other patents, Robert defeated three voting equipment patents and a middle eight figure demand.
Through summary judgments of invalidity or non-infringement and a jury verdict, Robert substantially defeated four semiconductor patents and thus reduced a middle eight figure demand to four figures.
Robert obtained summary judgments of invalidity or non-infringement for a Fortune 500 client against Ronald A. Katz Technology Licensing (RAKTL). RAKTL sued many corporate defendants asserting his 40+ patent portfolio and collected well over a billion dollars from all of them. Robert's client was one of the very few who did not pay anything.
Robert has obtained several low to middle eight-figure settlements for his patent owner clients.
