Elizabeth is a registered patent attorney with extensive experience in trademark and copyright law. She partners with clients to develop and implement forward-thinking and creative IP strategies. Clients appreciate Elizabeth’s scientific background and experience with the hospitality industry; consumer, chemical, and agricultural products; biological treatments; and medical devices. Elizabeth enjoys working with her clients on IP best practices and fostering a corporate culture of proactive thinking.
Elizabeth prosecutes U.S. trademark applications, manages international trademark portfolios, and clears potential new marks. She uses customized reports to streamline work flow—big picture updates with focused attention on upcoming deadlines. Elizabeth is in regular communication with U.S. trademark and copyright examiners and local trademark counsel around the world. She also advises on IP enforcement and litigation involving patent, trademark, copyright and trade dress infringement claims and handles proceedings before administrative agencies.
Elizabeth has helped clients implement mission-critical programs for focused brand protection and develop budget-friendly filing strategies to protect trademark and copyright assets. In one instance, she saved a client over $150,000 in next-action fees, and in another, she worked with the client's business team to create a flexible filing strategy that has served them well for almost seven years.
Elizabeth successfully opposed the registration of marks likely to cause confusion with her client's registered marks, obtaining a favorable summary judgment ruling and avoiding an administrative trial. When the defendant appealed to the District Court, Elizabeth was lead trademark counsel in the defense of the appeal, receiving all requested relief on a motion to dismiss and later a motion for summary judgment.
Skilled at avoiding protracted litigation, Elizabeth represented well-known restaurant brands on trademark infringement claims, which she creatively resolved in mediation to preserve the distinctive marks.
After expedited discovery and a hearing, she obtained a preliminary injunction to stop a competitor from using an infringing mark; the district court later entered a permanent injunction and awarded attorney's fees on summary judgment; affirmed on appeal.
Elizabeth initiated a cancellation proceeding against a sporting goods competitor's trademark registration in response to threats of litigation and obtained a favorable decision using the TTAB's Accelerated Case Resolution track.
She successfully wrestled domain names incorporating client marks away from cybersquatters before the National Arbitration Forum and World Intellectual Property Organization.
She externed for the Honorable Samuel Der-Yeghiayan of the Federal District Court for the Northern District of Illinois, 2006.
