Overview

Doug focuses on environmental law and natural resources law, with strong experience in environmental and toxic tort litigation. He advises businesses on environmental violations, handles complex environmental and insurance coverage actions, defends national resource damage claims and works with federal, state and local agencies on environmental matters.

Adept at Superfund enforcement actions and in numerous CERCLA cost recovery suits, Doug has a particular strength in handling electronic discovery (eDiscovery) for complex environmental and insurance coverage actions. He negotiates consent decrees with federal and state agencies regarding the disposal of hazardous waste, resolves actions concerning Clean Air Act violations, petroleum pipeline spills, bioremediation of petroleum wastes, air emission permit violations, risk management plans and General Duty Clause, and advises on wastewater discharge permit violations, waterways cleanups and coal gasification wastes.

Experience

Well versed in CERCLA (Superfund) litigation, Doug represents four clients in prosecution of large CERCLA suit involving chlorinated solvents and PFAS compounds on public airport property.

His counsel on a FIFRA claim for a national manufacturer included advising on their subsequent business and distribution plan.

Doug handles large declaratory judgment lawsuits involving property and pollution insurance coverage relating to floods, earthquakes and tsunamis.

He successfully defended the City of Overland Park, KS against multiple insurance carriers who issued policies to the city from the early 1960s to the late 1980s.

Doug has worked closely with more than 100 environmental expert witnesses and consultants on numerous subjects, giving him a huge advantage in resolving or litigating environmental disputes.

In support of the firm’s commitment to pro bono legal service, Doug has long volunteered time and resources to charitable organizations to advance the community.
