As former Regional Counsel for the U.S. Environmental Protection Agency, Dave offers clients practical insights and first-hand knowledge of how to effectively communicate with the EPA on key matters. He defends companies in actions by the EPA and state environmental agencies and represents clients on transactions with environmental issues.
Ranked as a Band 1 environmental lawyer by Chambers USA, what sets Dave apart is his “expert presence in the market for his litigation and regulatory practice.” Well known for his creative, proactive approach, Dave has notable experience relating to state environment agencies and federal investigations. His clients benefit from Dave’s extensive regulatory knowledge and deep understanding of the complex environmental laws, permitting issues and enforcement trends.
Dave has assisted chemical manufacturers and distributors, pipelines, railroads, electric generation and transmission companies, alternative fuel producers, developers of contaminated properties and individuals in proceedings including:
- Civil judicial matters, voluntary disclosures, and administrative
- Response to fire and explosion and chemical release events
- Response to search warrants
- Internal investigations of employee wrongdoing and false reporting
- Defense of agency civil and judicial actions seeking penalties and injunctive relief or cost recovery
- Voluntary disclosures and agency negotiations
He has represented companies in RCRA, Clean Air Act (including General Duty Clause), Clean Water Act and Superfund cases. Dave has worked on enforcement and permit actions involving air pollution, water pollution, toxic substances and chemical regulation under a variety of federal, state and local laws.
His experience and knowledge have been applied to issues in both administrative and judicial tribunals.
Dave has taught as an Adjunct Professor at the University of Kansas School of Law, the University of Missouri-Kansas City and Washburn University and served in a variety of professional and community organizations.
