Overview

Dan has tried and argued cases in state and federal courts throughout the Midwest, and represents industry leaders in financial services, global manufacturing, renewable energy, media and technology, health care, biotechnology, retail, defense, construction and transportation sectors. He concentrates his practice on complex business disputes in a variety of settings, including both prosecuting and defending lawsuits seeking emergency injunctive relief; non-compete and restrictive covenant enforcement; shareholder and ownership disputes; employment and civil rights claims; contract disputes; IP and trade secret claims; mass tort and toxic tort actions; class actions; insurance coverage claims; worksite injuries and deaths; eminent domain litigation; and corporate and government investigations. 

As a trusted advisor, Dan guides business leaders, elected officials and individuals facing significant change, challenges and opportunities. He reduces his client's risk exposure, often leading to early, practical and cost-effective resolutions. He has led business development, talent recruitment and development, pro bono and mentoring initiatives throughout his career, and sponsored leadership opportunities for both communities of color and women in business. 

As a servant leader, Dan is routinely engaged by civic organizations for thought leadership and counsel. Currently, he serves as a director and officer on the Board of Trustees at the College of Saint Benedict and the Board of Directors for the NHL Minnesota Wild Foundation. He has also served as a board member and investor in a privately-held company advancing the distributed production of green jet and diesel fuel, and spent two decades as a Saint Paul civic leader in various organizations such as the Saint Paul Area Chamber of Commerce, Saint Paul Historic Preservation Commission and City Hall.

Won emergency injunctive relief for a leading technology company in South Dakota federal court action, leading to securing of multimillion dollar business acquisition.

Won a $27 million Minnesota federal court judgment on behalf of biotechnology client stemming from breached supply agreement. 

Lead trial and appellate counsel for an American icon in high-profile Minnesota eminent domain action. 

Recovered a seven-figure sales commission on behalf of a decorated military veteran earned in one of largest robotics sales transactions in U.S. Army history. 

Secured a favorable “courthouse steps” settlement for energy client in a multimillion dollar business dispute with an energy company involving rail cars. 

Won a favorable seven-figure settlement for a bank client in complex, multi-jurisdictional lawsuits involving commercial loans, real estate and a national franchise. 

Teamed with a colleague to win a pre-lawsuit favorable settlement for a news media client in an employment matter involving a large investment bank. 

Won early dismissal for a family-owned business owner client in a multiparty, multimillion dollar catastrophic injury lawsuit, and held the victory on appeal. 

Won favorable seven-figure settlement for a highly-respected technology entrepreneur in minority shareholder and business tort lawsuit. 

Won appellate court reversal for an American icon in massive eminent domain action; reversed by Minnesota Supreme Court in highly-criticized decision. 

Successfully represented several energy, oil and gas clients in OSHA and wrongful death proceedings. 

Represented national franchise in high-exposure workplace sexual assault action. 

Successfully represented numerous doctors, dentists, mental health counselors, nurses and other licensees in several governmental investigations and licensure actions. 

Successfully represented numerous municipal statewide entities in various employment, premises and other general and tort liability actions. 

Successfully represented financial services industry leader in trade secret, tortious interference and breach of employee fiduciary duties action. 

Successfully managed, negotiated and secured numerous no-pay or de minimus dismissals of hundreds of mass tort lawsuits for diversified industrial manufacturer. 

Represented major, Midwest medical practice in physician termination matters. 

Won rare reversal on adverse medical licensing decision in favor of client physician. 

Won dismissal and settlement in Sarbanes-Oxley employment action. 

Secured repayment of embezzled funds for employer in termination action. 

Negotiated favorable settlement for product manufacturer in catastrophic equine fire loss.
