Brian works with clients in the energy industry to achieve their business and regulatory objectives.
Brian has spent his entire career representing businesses located throughout the U.S. in energy transactions and regulatory matters before the Federal Energy Regulatory Commission (FERC) and state utility commissions on issues ranging from power purchase negotiations to cost of service ratemaking to wholesale electric market design.
Brian advises energy investors and lenders, generation and transmission cooperatives, electric and gas utilities, renewable energy companies, independent power producers and transmission companies. He counsels market participants active in centralized energy markets at FERC on ratemaking, energy and capacity markets, transmission access and cost allocation, and generator interconnection. His state regulatory practice focuses on permitting renewable and traditional generation, pipeline and transmission facilities, cost-of-service ratemaking and ongoing regulatory compliance matters and representing utilities, developers and businesses before public utilities commissions.
Before practicing law, Brian clerked for the U.S. Environmental Protection Agency’s Office of Enforcement and Compliance Assurance in Washington, D.C., and worked for Facilities Management-Electric Distribution at the University of Iowa.
Represented market participants in major initiatives at FERC relating to the markets administered by ISO New England, PJM Interconnection, the Southwest Power Pool and the Midcontinent Independent System Operator, Inc.
Represented independent transmission company in cost-of-service rate cases before FERC.
Represented numerous market participants in settlement proceedings at FERC relating to reactive power revenue requirements, market uplift payments, cost of service rates and generator interconnection.
Represented investor-owned utilities and independent power producers at FERC seeking Section 203 authorizations for acquisition of electric generation and transmission facilities.
Represented renewable energy companies in the development and permitting of over 1000 MWs of utility scale wind and solar energy facilities before the Minnesota Public Utilities Commission and the North Dakota Public Service Commission.
Represented lenders associated with construction and/or debt financing of hundreds of MWs of utility scale solar and wind energy facilities.
Represented purchasers in negotiating power purchase agreements for over 1000 MW of wind and solar energy.
Represented investor-owned public utilities in cost-of-service rate cases, service territory disputes, and contested case litigation before states public utilities commissions.
