Overview
Anne has helped her clients prevail in all kinds of disputes that arise related to owning, insuring, and securing transactions with real property. Her practice also includes general commercial and civil litigation, business, banking and other insurance matters.
Anne works with national lending institutions and servicers, governmental entities, corporations, condominium and neighborhood associations, title insurance companies, title agents, and insured homeowners, lenders and servicers. She has helped to resolve issues over lien priority, indemnification, recoupment, foreclosure, mechanic's lien, mortgage and deed reformation, vexatious refusal, bad faith, easements, access, breach of warranty, surveyor negligence, title agent negligence, defalcation, errors and omissions coverage, breach of note, forgery and fraud.
Experience
Secured lenders and property owners have repeatedly turned to Anne for help discharging federal tax liens, applying to the IRS for lien discharge, appealing IRS decisions, and suing the IRS after exhaustion of administrative remedies.
When faced with widespread, systemic errors in mortgages, lending institutions relied on her to evaluate the scope and implication of the defects and design a comprehensive corrective plan of action.
Anne used novel legal arguments to release a mechanic's lien against real estate, transfer the lien to insurance proceeds on deposit with the court, and obtain the dismissal with prejudice of both secured lender clients, extricating them from ongoing, contentious litigation prior to appeal while preserving their respective mortgages.
She won an important appellate victory for a national secured lender concerning deeds of trust.
