Perry Glantz Publishes in Law360 on Colorado Contract Damages Precedent
In an article on Law360, Partner Perry Glantz examines a decision published by the Colorado Supreme Court in May. The case, Bermel v. BlueRadios Inc., could change legal remedies related to breach of contract claims in the state.
"Accordingly, pursuant to Bermel, a party that has suffered only economic loss from a breach of contract can assert a claim for civil theft and potentially recover treble damages and attorney fees for what is, in reality, a breach of contract," writes Perry.
He also discusses the implications of this case and a recent Colorado Court of Appeals decision, which together could change the way civil theft is used in litigation cases.
