Charles Redd Writes "An Eventful Year" Article for Trusts & Estates Magazine

Stinson Leonard Street LLP attorney Charles "Clary" Redd published a column in the January 2016 issue of Trusts & Estates magazine. In the piece, Redd takes a look at the important legislative, regulatory and case law developments for trust and estate professionals from 2015.

Redd examines the basis consistency rules in the Surface Transportation and Veterans Health Care Choice Improvement Act, which was signed into law in July. He also summarizes the most important provisions of the portability regulations the IRS finalized in June, and he analyzes a couple of important recent Tax Court decisions. The first, Mikel, was significant because it is the latest in a bad string of losses for the IRS in cases involving allowance of the gift tax annual exclusion when contributions have been made to irrevocable trusts whose governing instruments contained Crummey withdrawal rights. The second, Steinberg, addresses the efficacy of a fascinating technique that Redd calls a "net, net gift."
