Lessons from Litigation
Stinson invites you to join Sharon Markowitz on August 13 for a Lesson on Litigation with the focus on contractual risks to mortgage originators. This session is designed for in-house counsel in the financial services and mortgage industry.
Between 2013 and 2017, the ResCap Liquidating Trust brought roughly 100 indemnification actions against the mortgage originators from whom its predecessor (Residential Funding Company) bought loans—each alleging between $5 million and $2 billion in damages. Between 2016 and 2019, Lehman Brothers Holding Company brought nearly 200 similar (though somewhat smaller) actions against mortgage originators.
During this presentation, Sharon will talk about the contractual terms that pose the greatest risks to mortgage originators and their successors—terms to watch for during M&A due diligence and terms to try to revise in ongoing contracts.
