Monday, May 23, 2016 - Appellate Review of Administrative Agency Decision
Both the Administrative Procedure Act and the organic statutes authorizing the creation of various federal administrative agencies establish prerequisites and standards for review of agency decisions by the federal courts. Similar review provisions are found in state laws governing review of state administrative agency decisions. This CLE program will examine judicial application of the substantial evidence test, the arbitrary and capricious standard, judicial deference to statutory interpretations by administrative agencies (the Chevron test) and common procedural issues when agency decisions are challenged in court.
