Practice Overview We have an extensive mortgage lending practice which includes representation of lenders and borrowers in a wide range of real estate secured lending transactions. Our real estate finance attorneys have represented clients in loan transactions, including multi-state transactions, involving properties such as shopping centers, office buildings, multi-family dwellings, industrial facilities, residential communities, mobile home parks, mini-storage facilities, hotels, golf courses and agribusiness entities. We are familiar with all aspects of real estate lending, including lender liability and environmental hazards. Scope of Services The firm's lending practice includes representing banks, insurance companies and other institutional lenders, mortgage brokers and mortgage bankers, as well as borrowers in connection with the following conventional financing arrangements: Real estate loans Real estate construction loans Revolving credit facilities Bond financing transactions Assumptions Workouts Restructurings Judicial and non-judicial (trustee's sale) foreclosures of non-performing loans In addition, we assist in the development, documentation and implementation of national mortgage lending conduit programs, and represent conduit lenders as loan closing counsel. This representation includes: Preparing handbooks used in connection with loan closings Preparing, reviewing and revising form loan documents and related documents in conduit lending programs Assisting in the initial setup of the procedures Of Note For some lender clients, we serve as regional counsel, and in multi-state loan transactions, we have served as local counsel. We also assist lenders in establishing consumer loan programs. We represent lenders and borrowers in connection with low income housing transactions, which may involve HUD-insured loans, issuance of GNMA securities, and low income housing tax credits.
