Practice Overview We provide local, regional and national environmental representation to the energy sector, public utilities, agricultural enterprises, industrial, chemical and manufacturing concerns, lending institutions and governmental agencies in virtually every area of environmental law. Our experience also spans to laws protecting natural resources, particularly as those laws relate to site development and contaminant release response. We represent clients in regulatory compliance and rulemaking, administrative hearings, Superfund and toxic tort litigation and insurance coverage. In addition, we assist clients in drafting and negotiating environmental provisions in transactional documents such as mortgages and leases and allocating environmental liabilities in business transactions. Scope of Service We help clients resolve environmental issues quickly, whether the issues are between our clients and private parties, or our clients and regulatory agencies. Our experience includes the following: Advice on and interpretation of regulatory requirements and developments under major federal environmental laws including the Clean Air Act, Clean Water Act, Toxic Substances Control Act, Resource Conservation and Recovery Act, Oil Pollution Act, Superfund and other federal, state and local requirements Defense of administrative and court proceedings alleging violations of environmental laws Defense of toxic tort and chemical exposure actions Securing required permits authorizing the discharge of pollutants, air emissions, the generation, handling, storage or disposal of hazardous substances, and doing so in compliance with the Emergency Planning and Community Right-to-Know Act Structuring environmental aspects of the purchase, sale or acquisition of interests in real estate and business enterprises Superfund representation including remedial investigation and feasibility study issues, liability litigation and obtaining contribution from third parties Working with federal and state resource agencies and departments in responding to releases and in obtaining authorizations and permits required for operations Development of environmental compliance strategies for ongoing operations Advice to business regarding the impact and significance of their environmental compliance obligations on financial statements or SEC disclosure requirements Responding to information requests issued by EPA and state agencies under Superfund, Clean Air Act, Clean Water Act, Toxic Substances Control Act and hazardous waste laws Advocating for and assisting clients in drafting or responding to state and federal legislation and administrative rulemakings Assuring compliance with risk management, release notification and release response under federal and state laws Assisting clients in creating and implementing Environmental Management Systems and disclosing discovered violations under state and federal self-disclosure programs Insuring compliance with wetlands and endangered species requirements in facility operations and expansions Responding to natural resource damages claims under the federal Superfund law, federal Oil Pollution Act, and state natural resource damages recovery laws Handling water rights issues ranging from acquisition to quantification to sale Of Note Four of our practice group members are listed in The Best Lawyers in America for their environmental law proficiency, including a former EPA Regional Counsel for Region VII.
