Our attorneys defend employee benefit plans, their sponsors, administrators and fiduciaries, as well as insurers, from alleged violations of the Employee Retirement Income Security Act (ERISA), including: claims of breach of fiduciary duty; claims of wrongful denial of benefits; claims of failure to provide plan information; and claims of retaliation and interference with benefits.
Scope of Service We offer a broad range of ERISA and benefits litigation services to clients. Our areas of focus include: Defense of claims involving a wide variety of ERISA-covered plans, from standard defined benefit and defined contribution pension plans and ESOPs to various types of employee welfare benefit plans, including single-employer and multi-employer or association plans Defense of claims against employee benefit plans, such as governmental and church plans, that, for one reason or another, are exempt from ERISA Defense of insurers who fund the benefits provided to employee welfare benefit plans and administer claims for benefits, such as providers of life, health and disability insurance Defense and prosecution of claims for breach of contract, breach of fiduciary duty, professional negligence and related claims, brought by and against service providers to ERISA-covered plans, such as third-party administrators, plan marketing agents, professional advisors and reinsurers Defense of class, multiple plaintiff and individual plaintiff claims of ERISA violations Counsel and assist clients in resolving adversarial situations related to employee benefits that have not matured to litigation Of Note We have represented clients in adversarial proceedings including Department of Labor investigations; plan claims procedures; and litigation (including preliminary injunction practice, trial and appeal).
