Michael G. O'Flaherty

• Property Taxation: Mike has represented owners of commercial, industrial and residential property in appealing their valuations. He has also consulted with clients on a variety of property tax matters and handled requests for property tax exemptions.
• Commercial and Residential Acquisitions, Sales, Purchases and Closings: Mike represented buyers and sellers in sales and purchases of all types of properties, ranging from single family sales to some of the largest commercial transactions in the Kansas City area. In these representations, his involvement has included the preparation and negotiation of the contract documents, the satisfaction of the various conditions and requirements, preparation and review of the deed and other closing documents and the managing of the closing.
• Large Scale, Multi-Use, Development Projects: These representations have included land acquisition issues, the preparation and negotiation of development agreements and the coordination of the development activities of the various constituent parties, development incentive issues, the review of developer financing agreements and arrangements and the closing of the transactions. These have also involved tax increment financing, tax credits and community improvement district work and representation of private developers and public bodies in major public/private partnership transactions.
• Representation of Lenders and Borrowers in Financings: In financing transactions, Mike’s experience has included the structuring of the loan, the preparation and negotiation of the loan documents, the satisfaction of the various loan conditions and requirements prior to closing, and the closing and funding of the loan proceeds. He also has had extensive experience in loan workouts, loan modifications, foreclosures and receiverships.
• Landlord and Tenant Matters: Mike has represented landlords and tenants in numerous leasing transactions, large and small. This has involved the preparation and negotiation of the lease and representation in the ongoing landlord-tenant relationship.
• Zoning and Planning: Mike’s practice has included zoning and planning issues at all levels. He has assisted clients in the review of existing laws and regulations to assure compliance. He has been involved in many efforts to secure the proper zoning and land use compliance including the presentations to public bodies. In some cases, this has involved the making of legislative changes to the existing laws.
  

Mike spent the majority of his career in private practice with Stinson Morrison Hecker LLP. During that time served as the head of the firm's real estate group. He has had extensive experience with many of Kansas City's most significant transactions and projects. He was deeply involved in the firm's representation of the Unified Government of Wyandotte County/Kansas City, Kansas in developing the Kansas Speedway and the nearby retail developments that include Nebraska Furniture Mart, Cabela's and the Legends Shopping Center. He also participated in the development of the Downtown Kansas City, Missouri Public Library. He returned to the firm in 2009 after serving as the Director of Assessment of Jackson County, Missouri from May 2003 to August 2007. With Jackson County comprising more than 600 square miles and more than 600,000 residents, O'Flaherty was responsible for assessing and valuing real estate and personal property for a combined value of more than $8.8 billion.
