Mark is a proven advocate with broad successful experience in substantial business and public law litigation and arbitrations. This experience includes defense of business and consumer class actions, patent and other intellectual property cases, securities litigation, bet-the-company industrial accidents and business contract disputes. He has also represented clients in substantial construction disputes concerning business, residential, industrial and public works projects. Mark has successfully defended business and governmental clients in many matters involving tens and hundreds of millions of dollars, and has also obtained multiple multi-million dollar judgments for business clients as plaintiffs. He is a frequent speaker and author on trial practice and attorney professional responsibility. Mark has been recognized as a Fellow of the American College of Trial Lawyers. Mark serves as the firm's Managing Partner and is a member of its Executive and Policy Committees.

Representative Experience

Lead or co-lead counsel in several high profile crisis cases:
- Lead counsel to owner of major Midwestern grain facility in multiple civil cases, OSHA proceedings, a criminal referral investigation and other high profile issues resulting from a catastrophic explosion causing death and injury, and property damage in excess of $40 million.
- Co-lead counsel in successful defense of class actions arising from oil spill at flooded oil refinery, and subsequent actions for insured losses substantially in excess of $100 million.
- Successful conception and representation of a unique defendants’ class of more than 1100 landowners to oppose land claims by the Wyandotte Nation to an industrial and residential area of Kansas City, Kan., with billions of dollars in property at stake. The tribe’s claims were dismissed based upon arguments developed concerning 19th Century Treaties. Subsequently led successful effort to recover substantial portion of fees expended in defense.
Lead representation of a telecommunications company in more than two dozen nationwide consumer and business class actions (including MDL proceedings), securities litigation, license and contract disputes, and other matters.
Lead counsel for major election equipment firm in defense of multi-patent infringement allegations.
Lead counsel in construction litigation matters in industrial (e.g., power plant cooling tower, natural gas processing, industrial coating, petroleum refinery), public (e.g., airport runway, landfill, bridge, domed stadium), and other commercial (e.g., multi-family apartment) projects involving tens of millions of dollars in claims.
Lead counsel in cases concerning license agreement between major consumer products companies (defense of $20 million arbitration claim, defense award); acquisition of financial services company (successful prosecution of multi-million dollar arbitration claim); business acquisition (multi-million dollar jury verdict) and construction defect (multi-million dollar trial judgment).
