Emmett has represented plaintiffs and defendants in securities fraud, corporate governance, director and officer liability, and high-stakes business torts cases.

Overview

Emmett's most notable securities cases include litigation over municipal bonds, drops in stock price, the regulatory blockage of what was then regarded as the largest corporate merger in history, business failure, and alleged misrepresentation in financial reporting.

For 25 years, Emmett served as lead counsel to Sprint in multiple putative national and statewide class actions in which plaintiffs alleged that railroads do not have adequate title to permit a telecommunications use in their right-of-ways. He has also handled matters involving the fair market value of a right to use a railroad right-of-way, the allocation of relocation responsibilities between a telecommunications company and a right-of-way provider, and right-of-way condemnations.

Emmett also defends manufacturers of consumer products in actions alleging that the products contain PFAS or benzene or that the products do not perform as advertised.

Emmett is a member of the American Arbitration Association’s Panel of Arbitrators and a member of the Neutral Roster of Alaris ADR.
