Don serves as counsel for a number of local and regional privately held companies. In that capacity, he regularly advises on issues of corporate governance and he handles multifaceted legal issues confronting small to medium size companies, both in and out of court. Additionally, by virtue of his specialization in the area of employment law, he routinely represents these clients as well as a number of additional clients in connection with their human resource issues. In these dual capacities, Don has handled a variety of business-related litigation with an emphasis on litigation defending against claims of employees and former employees. In addition to litigating employment issues, he has considerable experience advising employers in connection with all forms of employment related legal issues that are not related to litigation. He regularly advises and litigates in connection with non-compete, non-disclosure and non-solicitation agreements.

Representative Experience

Companies counseled and defended by Don in employment related matters range in size from three employees to more than 1000 employees, and this representation has run the full gamut of employment issues from hiring to reductions in force, plant closings and routine discharges. His representation of employers covers a wide range of industries including manufacturing concerns, service companies, the hotel and lodging industry, the movie exhibition business, the mortgage loan business, advertising, delivery and insurance related businesses. He has also handled recurring litigation in the field of securities law and in the debt collection business, and he has represented businesses in a wide variety of business related contract disputes and business torts, including disputes over the enforcement of restrictive covenants. Don has also recently and successfully represented a national manufacturer in a number of arbitration hearings convened by the Federal Mediation & Conciliation Service as a result of grievances filed by various employees and the Union under a collective bargaining agreement. Our financial services client was recently sued in Kansas state court and before the NASD by a discharged financial representative who was a former employee. All requests for injunctive relief were defeated at an extended hearing and the damage claims were dismissed upon extremely favorable settlement terms.

Of Note

Don served on active duty with the U.S. Army from 1971-1973 when he was honorably discharged as a First Lieutenant. While affiliated with a prior law firm, Don served as Managing Partner for a period of approximately five years.
