Dennis, a member of the firm’s Energy Group, has represented, since his return to the firm after serving for five years as Solicitor of the Federal Energy Regulatory Commission, clients in electric transmission, oil pipeline and natural gas rate and certificate matters at the Federal Energy Regulatory Commission. Dennis has also participated in rulemaking proceedings at FERC and other federal agencies, including copyright issues in several rulemaking proceedings at the Copyright Office as well as on air quality standards for lead at the Environmental Protection Agency.

Representative Experience

Extensive appellate litigation experience concerning FERC, FCC, copyright, and administrative agency proceedings; as FERC's Solicitor, presented or supervised the preparation of briefs and oral arguments in over 150 cases with published opinions
Before FERC, represented an oil pipeline shipper in a series of ongoing disputes with a pipeline concerning potential cross-subsidy issues related to construction of new pipelines and a natural gas producer in an ongoing proceeding concerning the proposed expansion of a storage field into an area where the producer's wells are located
Counseled clients seeking to invest in electric transmission and generation projects about the potential impact of and risks related to FERC regulation on contractual and rate issues, including market-based ratemaking authority, interconnection arrangements with RTOs for traditional and wind generation projects, and related matters
Submitted comments to the Copyright Office on behalf of television producers and syndicators in rulemaking proceedings addressing the copyright impacts of the transition to digital television and the potential impact of providing television programming via the Internet and closed loop (e.g. FIOS) delivery systems; counseled clients on propsed federal legislation dealing with these technological developments
Submitted comments on behalf of a major producer of lead in response to the Environmental Protection Agency's advanced notice and notice of proposed rulemaking on revision to the national ambient air quality standards for lead
